most current terms and conditions of the FSCTS EULA at the address below as they become available. Use of the
FSCTS after the effective date of the changes, as specified in the lower left corner of the EULA document will
constitute your consent to the changes.
No failure on the part of any party to exercise and no delay in exercising, any right, power, or remedy under this
FSCTS EULA will operate as a waiver thereof, nor will any single or partial exercise of any right under this FSCTS
EULA preclude any other or further exercise thereof or the exercise of any other right.
15. EXPORT RESTRICTIONS.
The FSCTS and its underlying technology are subject to U.S. government export controls contained in the Export
Administration Regulations. The FSCTS is exportable under license exception ENC. Export or distribution to the
following countries, or to nationals or residents of the following countries, is prohibited: Cuba, Iran, Iraq, Libya, North
Korea, Sudan, and Syria. Prohibited countries are subject to change. Federal law also prohibits the distribution,
exporting, or re-exporting of the FSCTS to anyone on, or under the control of any person on, the U.S. Commerce
Department Bureau of Export Administration's List of Denied Persons or theU.S. Treasury Department Office of
Foreign Asset Control's list of Specially Designated Nationals. You acknowledge and agree to be bound by these
restrictions.
16. GENERAL.
You acknowledge and agree that each provision of this FSCTS EULA that provides for a disclaimer of warranties or
an exclusion or limitation of damages represents an express allocation of risk, and is part of the consideration of this
FSCTS EULA. Invalidity of any provision of the FSCTSEULA shall not affect the validity of the remaining provisions of
this agreement. This FSCTS EULA is governed by the laws of the State of New Mexico without application of the
principles of conflicts of laws of this or any other state. You agree that all actions or proceedings arising in connection
with this FSCTS EULA shall be tried and litigated exclusively in the state and federal courts located in Albuquerque,
New Mexico. The Foundation for the Study of Cycles, Inc.'s affiliates, agents, vendors, and licensors are intended
third party beneficiaries of this FSCTS EULA. Should you have any questions concerning this FSCTS EULA, please
